EAC Plié Portal Terms & Conditions

Please review these Terms & Conditions before creating or using an EAC Plié Portal account. By creating an account, logging in, enrolling in classes or events, submitting information, or using portal features, you agree to these Terms & Conditions, the EAC Privacy Policy, the EAC SMS Terms & Conditions when applicable, and any additional EAC policies, waivers, payment terms, or enrollment requirements presented at the time of registration or purchase.

1. Introduction and Acceptance of Terms

These Terms & Conditions govern access to and use of the EAC Plié Portal and related digital services made available by Elite Arts Company, LLC (“EAC,” “we,” “our,” or “us”). The portal may be used for account management, dancer profiles, enrollment, billing, payment plan selections, waivers, communication preferences, class and event information, and other studio-related functions.

By creating an account or using the portal, you confirm that you have read, understand, and agree to these Terms & Conditions. If you are creating an account on behalf of a minor dancer, you confirm that you are the dancer’s parent or legal guardian, or otherwise have legal authority to provide information, make selections, and accept terms on the dancer’s behalf.

2. Eligibility and Parent/Guardian Responsibility

EAC primarily serves minors participating in dance education programs. In most cases, Parents and/or Legal Guardians create the primary EAC Plié Portal account which becomes the family account when dancer profiles are added.  Accounts for minor dancers must be created, managed, and approved by a parent or legal guardian. Parents and guardians are responsible for the accuracy of all information submitted through the portal and for monitoring portal activity connected to their family account.

3. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree not to share your password with anyone who should not have access to your family account, dancer information, billing details, or EAC communications.

EAC may use account verification, password protections, and two-factor authentication or similar security features to protect accounts. You agree to notify EAC promptly if you believe your account has been accessed without permission or if your login information has been compromised.

4. Portal Use

The EAC Plié Portal is intended for legitimate studio-related use by EAC families, dancers, staff, and authorized users. You agree to use the portal respectfully, lawfully, and only for its intended purpose.

EAC reserves the right to restrict, suspend, or terminate portal access if an account is misused, if information is believed to be inaccurate or unauthorized, or if use of the portal creates a safety, privacy, operational, or financial concern.

5. Enrollment, Class Placement, and Studio Participation

The portal may allow users to view, request, purchase, or manage class enrollments, events, packages, competition team participation, waivers, and related studio services. Enrollment is subject to class availability, eligibility requirements, age or level guidelines, instructor approval where applicable, payment status, and EAC policies.

Submitting an enrollment request, adding an item to a cart, or viewing a class in the portal does not guarantee placement unless the enrollment is completed and accepted according to EAC’s current process. EAC may adjust, decline, or remove an enrollment when necessary due to placement concerns, capacity limits, prerequisite requirements, unpaid balances, incomplete waivers, safety concerns, or other studio needs.

Participation in classes, events, performances, competitions, or other EAC activities may require additional waivers, attendance expectations, dress code compliance, conduct expectations, payment terms, or program-specific agreements.

6. Payments, Billing, and Payment Plans

Prices, fees, deposits, tuition, event costs, costume costs, competition costs, processing fees, payment plan options, due dates, and refund policies may vary by class, event, package, program, or semester. You are responsible for reviewing all costs and payment terms before completing a purchase or enrollment.

Payments may be processed through third-party payment processors connected to the EAC Plié Portal, or other approved systems. EAC does not store full credit card information directly on its servers.

If a payment plan option is selected, you must review and accept the specific payment plan terms presented at checkout or within the portal before proceeding. A payment plan applies only to the specific items in the cart or transaction at the time the payment plan is accepted, unless otherwise stated in writing by EAC. Additional purchases may require a separate payment plan agreement.

For semester courses, enrollment and payment are for the full semester commitment unless EAC specifically states otherwise in writing. Choosing to discontinue attendance partway through a semester does not automatically cancel the financial obligation associated with that semester course or any accepted payment plan.

Failure to maintain payment status, complete required payments, or resolve outstanding balances may affect portal access, future enrollment, event participation, performance eligibility, competition participation, account standing, or access to future payment plan options.

7. Refunds, Credits, and Account Balances

Refunds, credits, transfers, and account balance adjustments are subject to EAC’s current policies and the terms presented for the applicable class, event, purchase, or program. Some fees, deposits, costume costs, competition fees, third-party charges, ticket purchases, or special event costs may be non-refundable or non-transferable.

Store credits, class credits, or other account credits may be limited by expiration dates, eligible use categories, program restrictions, or other conditions shown in the portal or communicated by EAC.

8. Waivers, Medical Information, and Safety

Participation in EAC programs may require completion of medical waivers, liability waivers, emergency contact information, and other forms. You agree to provide accurate and current information and to notify EAC of any medical, injury-related, behavioral, or safety information that may reasonably affect a dancer’s participation.

EAC uses medical and emergency information to help support dancer safety, instructor awareness, and emergency response. EAC staff are not medical professionals, and no decision, observation, or action by EAC should be interpreted as medical advice, diagnosis, or clearance to participate. Parents/guardians retain full responsibility for determining whether a dancer is medically able to participate in dance activities.

EAC reserves the right to require written medical clearance from a qualified healthcare provider before permitting a dancer to begin, resume, or continue participation in any EAC class, rehearsal, performance, event, or activity. EAC may deny or restrict participation if medical clearance is not provided when requested, or if EAC reasonably determines that participation may present a safety concern for the dancer, staff, or others.

Dance activities involve physical movement and inherent risk. By enrolling in or participating in EAC programs, you acknowledge that injuries may occur despite reasonable safety practices and supervision.

9. Communications and Notifications

EAC may communicate with families through the EAC Plié Portal, email, SMS/text messaging, phone, website updates, social media, printed notices, or other approved communication channels. Communications may include account notices, enrollment confirmations, invoices, receipts, schedule updates, policy reminders, class changes, emergency alerts, waiver reminders, and other operational information.

You are responsible for keeping communication information current and reviewing EAC communications in a timely manner. Failure to read or receive a communication does not necessarily excuse missed deadlines, missed payments, missed rehearsals, dress code issues, schedule changes, or other obligations.

10. SMS/Text Messaging

EAC may use SMS/text messaging for two-factor authentication, account verification, emergency weather closures, last-minute schedule changes, operational alerts, account-related notifications, and limited studio reminders or updates. Some SMS messages may be essential for account security or portal functionality. Optional or non-essential SMS notifications require opt-in consent.

By providing a mobile phone number and opting in through the EAC Plié Portal or other EAC systems, you consent to receive SMS communications from EAC as described in the EAC SMS Terms & Conditions. Consent to receive non-essential SMS messages is not a condition of purchasing services. Standard message and data rates may apply.

You may opt out of non-essential SMS communications by replying STOP where applicable, updating notification preferences within the portal, or contacting EAC directly. After opting out, you may still receive essential account security messages when required for authentication or account protection.

11. Privacy and Data Use

Information collected through the portal and related EAC systems is handled in accordance with the EAC Privacy Policy. This may include parent/guardian information, dancer information, contact details, emergency contacts, birthdates, enrollment records, attendance records, waiver information, medical or injury-related information voluntarily provided by families, billing information, communication preferences, and website or device information.

EAC uses collected information to process registrations, manage accounts, communicate important studio information, send invoices and reminders, support dancer safety, organize classes and events, protect account security, improve operations, and comply with legal or financial obligations. EAC does not sell personal information to third parties.

EAC may use trusted third-party service providers to support studio operations, including but not limited to TextMagic, Google Workspace, Microsoft Outlook, Ticket Tailor, Band App, and payment processing providers. These providers may process information according to their own policies and terms.

12. Photos, Videos, and Media

EAC may capture photos or videos during classes, competitions, performances, rehearsals, and events. These materials may be used for social media, marketing, studio displays, website content, promotional materials, or other studio-related purposes, subject to EAC’s media practices and any applicable media preferences submitted by families.

Families may submit media preference requests in writing. However, EAC cannot guarantee exclusion from group event photography, public performances, audience-captured media, competition media, or third-party event coverage.

13. User-Submitted Content and Uploaded Materials

The portal may allow users to submit or upload documents, forms, images, videos, medical information, waiver responses, notes, or other materials. By submitting content, you confirm that you have the right to provide the content to EAC and that the content is accurate to the best of your knowledge.

Uploaded files should be appropriate, relevant, and necessary for EAC studio operations. EAC may remove or decline files that are inappropriate, excessive, unrelated, technically unsafe, or inconsistent with portal requirements.

EAC may set file size limits, file type limits, upload limits, storage limits, or retention limits for portal submissions. EAC is not responsible for failed uploads, corrupted files, device issues, internet connection problems, or unsupported file formats.

14. Availability, Accuracy, and Technical Limitations

EAC works to keep the portal accurate and available, but the portal may occasionally be unavailable or contain errors due to maintenance, updates, internet interruptions, third-party service issues, technical failures, or data entry mistakes. EAC does not guarantee uninterrupted, error-free, or fully secure portal access. All payments made through the portal, including any saved payment methods, are processed and stored through a secure third-party payment processor; EAC does not directly store full credit card or bank account information within the portal.

If you notice an error involving enrollment, billing, dancer information, schedule details, or account data, please contact EAC promptly. EAC reserves the right to correct portal errors, including pricing, enrollment status, account balances, schedules, class information, or communication settings.

15. Third-Party Services

The portal and related studio operations may connect to or rely on third-party services for registration, payment processing, email, SMS messaging, ticketing, forms, file storage, analytics, or other operational needs. EAC is not responsible for third-party platform outages, technical issues, policies, processing delays, data practices, or terms of use.

Use of third-party services may be subject to those providers’ separate privacy policies, terms, fees, security practices, and availability limitations.

16. Account Restrictions and Termination

EAC may restrict, suspend, or terminate access to the portal when necessary to protect dancer safety, family privacy, account security, payment integrity, studio operations, or compliance with EAC policies. Reasons may include suspected unauthorized access, misuse of portal tools, inaccurate or incomplete information, unpaid balances, abusive communication, policy violations, or other conduct inconsistent with EAC expectations.

Restriction or termination of portal access does not automatically cancel outstanding payment obligations, accepted payment plans, enrollment commitments, or other agreements already made with EAC.

17. Changes to These Terms

EAC reserves the right to update or modify these Terms & Conditions at any time. Updated versions will be posted on the EAC website, within the EAC Plié Portal, or otherwise made available with a revised effective date.

Continued use of the portal after updated terms are posted or made available constitutes acceptance of the revised Terms & Conditions. EAC may require users to accept updated terms before continuing to use certain portal features.

By selecting “I Agree,” creating an account, or continuing to use the EAC Plié Portal, I acknowledge that I have read, understand, and agree to the EAC Plié Portal Terms & Conditions. I also acknowledge that I have access to and agree to the EAC Privacy Policy and, if I opt in to SMS/text messaging, the EAC SMS Terms & Conditions. If I am creating or managing an account for a minor dancer, I confirm that I am the parent/legal guardian or have legal authority to act on the dancer’s behalf.
